ANATEL – NATIONAL TELECOMMUNICATIONS AGENCY

Any foreign entity interested in obtaining ANATEL certification must have a legally established company in Brazil to act as its legal representative. This company will be responsible for the quality of the products, providing parts, and technical assistance for the products within the national territory.

All telecommunications products or products incorporating technologies using the radio frequency spectrum, such as Bluetooth and Wi-Fi, for example, require compulsory Anatel certification for commercialization in Brazilian territory.

After issuing the technical conformity certificate, homologation (product release for commercialization) is done directly by the Agency.

Why Inmetro product certification?

Inmetro is responsible for managing the Conformity Assessment Programs within the Brazilian Conformity Assessment System (SBAC).

Your business is assisted in implementing conformity assessment programs for products, processes, services, and personnel, aligned with the policies of the National System of Metrology, Standardization, and Industrial Quality (Sinmetro) and international practices, promoting competitiveness, fair competition, and protection of citizens' health, safety, and the environment.

Product or service certification, management systems, and people is, by definition, carried out by a third party, that is, by an independent organization accredited to perform this type of Conformity Assessment.

Conformity assessment for regulated products

Evaluating the conformity of a product means verifying whether it is produced according to the minimum required standards. In Brazil, Inmetro is the body responsible for establishing conformity assessment programs for products.

These programs may have voluntary or compulsory requirements. In both cases, products that meet these requirements receive a seal representing this compliance.

Voluntary programs are those where the requirements may or may not be followed by the manufacturer.

Compulsory programs are those establishing mandatory requirements for production. They are generally associated with products presenting risks related to health, safety, and the environment. In such cases, all products marketed in Brazil must comply with the regulation and have the conformity identification seal, according to Inmetro. The regulation applies to any product sold in Brazil, whether domestic or imported.

How to certify my product?

The first step is to determine whether your company is subject to applicable certification for your product and whether this certification is compulsory or voluntary. The list of products covered by the Conformity Assessment Program developed by Inmetro can be consulted on the institute's website.

The next step is to assess whether your company meets the necessary requirements to request certification by reading the corresponding standard or regulation. After this assessment, the company must seek a Product Certification Body (OCP) accredited by Inmetro to carry out the certification process for its product.

Object Registration

1. What is Registration, and what is it for?
   Registration is the process through which Inmetro authorizes, subject to the Certificate of Conformity, the use of the Conformity Identification Seal on certain products. This registration confirms that a product complies with the requirements established by Inmetro.
2. What is a Certificate of Conformity?
   The Certificate of Conformity is the document issued after an assessment procedure, indicating that a product complies with a specific standard or regulation. It is one of the basic requirements for obtaining the Object Registration with Inmetro.
3. Where are the general procedures for Object Registration defined?

4. What should be submitted in the Registration process?
   All products and services regulated by Inmetro that must undergo the registration process. This includes all required documentation and, in some cases, the submission of samples for testing in an accredited laboratory, as provided in the RAC (Conformity Assessment Regulation) of the specific product.

There are more than 2,000 categories of products that must undergo NOM approval before entering the Mexican market. To facilitate your NOM certification, CH Consulting can gather the necessary product documentation and determine the applicable NOM standards to save time and reduce testing and certification costs.

Coordinate the shipment of samples for testing, and if necessary, handle this through our shipping and customs broker company. Additionally, we test according to NOM standards and monitor progress until obtaining NOM Certification, as well as assist with product and packaging labeling and help you prepare the product manual and warranty in Spanish.

Some products requiring NOM certification include household refrigerators, freezers, gas heaters, washing machines, air conditioners; small induction motors and motor-operated tools; vertical and submersible water pumps; compact fluorescent lamps and wiring devices; telecommunications products that are data transmitters (digital, analog, LAN, or WAN systems) and those intended to be connected to the Public Telecommunications Network (PTN) and designed to process, receive, transmit, or convert signals.

According to Mexican law, the holder of the NOM certificate is responsible for the product's warranty, maintenance, and liability.

NOM certificates are non-transferable. However, a manufacturer holding a NOM certificate can extend the usage rights of their NOM certificate to Mexican distributors, who can then obtain their own NOM certification without additional testing. NOM certificates will only be issued to Mexican manufacturers and exporters or to manufacturers and exporters in countries with which Mexico has a free trade agreement.

Extensions and Validations

If we act as your certificate holder and legal representative, we can obtain “extension” safety certificates on behalf of your importers/distributors once you have identified them.

For telecom products, we will validate each importer/distributor in the IFETEL system, which customs will check at the time of equipment import into Mexico.

ARGENTINA

Most products require testing in Argentina; Modular and System approvals may vary depending on the equipment’s characteristics.
